Community law should not over ride statutory
provisions. The recent circular issued
by Local Administration Principal Secretary directing civic bodies to register
marriages of Muslim men below 21 years and women below 18 years but over 16
years, is out of the ordinary. The circular was intended woo a section of the
Muslim community and it was issued on the direction of a minister of the Muslim
League.
This circular in another way persuade members
of the other community to convert into Muslim if they decide to marry at an age below 18. What
the Kerala Government has done is an act to maintain child marriage in any
community. It is against the provisions of the Prohibition of Child Marriage
Act. The government should immediately withdraw the circular.
